Emerging Technologies and Judicial Integrity

Judicial Integrity Network in ASEAN has started a major research and mapping initiative to better understand how emerging technologies affect judicial integrity, both positively and negatively.

The digitalization trend and use of new technologies has accelerated in the response to the pandemic, with many courts adopting online hearing capabilities and transitioning to online forms. Artificial Intelligence, digital platforms, Open Justice all continue to transform justice systems around the world. This project is examining these developments from the lens of protecting judicial integrity.

The project has three research components:

  • Surveying of the judiciary in JIN ASEAN member countries
  • Mapping of justice-related emerging technology projects
  • Sector research into emerging technologies and the impact on judicial integrity

Online surveys have been launched, inviting judges and judicial administrators to share their experiences with different kinds of emerging technologies, particularly in the context of pandemic-related acceleration of technological changes in court operations. A strategic foresight approach will allow the judiciary in ASEAN to consider the impact of emerging technologies looking forward.

The project asks key inquiry questions:

  1. How are emerging technologies impacting judicial integrity?
  2. What are the judicial integrity implications of digitization, case management, artificial intelligence, online courts, online dispute-resolution, data security and privacy?
  3. How are emerging technologies affecting transparency, trial fairness, accessibility, appellate implications?
  4. What are the impacts of emerging technologies on the judicial experience and the court user experience?
  5. What promising practices to future proof judicial integrity can be integrated into technological changes in courts?

The research and consultation process will result in these knowledge products and an online event:

  • Research paper mapping emerging technology trends in the justice sector
  • Identification of technology trends that support judicial integrity
  • Identification of technology trends that jeopardize judicial integrity
  • Pragmatic tools to protect judicial integrity in the process of technological change
  • Online event to share research results (June/July 2021)

The research is focused on judges and judicial administration within the JIN ASEAN network as well as technologists, technology companies, privacy advocates, rule of law advocates, human rights practitioners, lawyers, court administrators, academics and public users of courts.
